​​​Act 128 of 2022 - Registration of Temporary Health Care Services Agencies

On November 3, 2022, ACT 128 of 2022, amending the HealthCare Facilities Act, providing for the registration and regulation of temporary healthcare services agencies.

Temporary Health Care Services Agencies are defined as any person engaged for hire in the business of procuring temporary employment in health care facilities for certain health care personnel (including nurse aides, registered nurses, licensed practical nurses, and direct care staff).

Act 128 provides that that any person that owns or operates a temporary health care services agency shall register annually with the Department and provide a list of each separate location.

Along with registration, Act 128 establishes requirements that temporary health care service agencies must abide by including, but not limited to, complying with all pertinent requirements relating to the health and other qualifications of personnel in health care facilities.

Registration Requirements

An agency can download the application for registration from the link listed. A complete application includes mailed check and supporting documentation:

  • Proof of medical malpractice
  • Proof of workers compensation
  • Proof of dishonesty bond or fidelity bond. Commercial crime insurance not accepted. See interpretive guidance link.

What is the cost of registration?

Under the statute, the annual registration fee is $500. The Department may increase the fee in regulation.​

Registration Renewal Requirements

The registration renewal requires the same application and supporting documents as the initial registration. This includes summary of workers compensation in PA and professional liability, dishonesty bond per legislation (not crime), type and complete fillable application and check. Check should have FEIN# in memo as well as the DOHID# from certificate. All items must be sent in one packet to ensure application and check is applied to the correct record.​
