Smoking Ban and the Pennsylvania Liquor Control Board
The Clean Indoor Air Act of 2008 generally prohibits smoking in public places, which include enclosed workplaces, commercial establishments and areas where the public is invited or permitted.
There are exceptions to the general prohibition, including certain exemptions that may apply to PLCB licensees. For example, licensed establishments whose total annual food sales are not more than 20 percent of the establishment’s total annual sales are not required to comply with the smoking ban.
The PLCB is not responsible for administering the Clean Indoor Air Act. Questions related to the act, exemptions to the smoking ban and what information a PLCB licensee may need to provide to the Department of Health for a specific exemption should be directed to the Pennsylvania Department of Health.
